Senate Completes First Day of Eighth Plenary Session

About the Eighth plenary session of the Senate of Oliy Majlis of Uzbekistan.

On 23 March 2012, the Eighth plenary session of the Senate of Oliy Majlis of Uzbekistan was opened in Tashkent city.

It was attended by invited members of the Cabinet of Ministers, heads of ministries and departments, as well as the representatives of the media. The meeting was presided by I.Sobirov, the Chairman of the Senate.

The senators discussed and approved the constitutional law of the Republic of Uzbekistan “On next elections to representative bodies of the state power and president of Uzbekistan”.

According to the law, the presidential elections in Uzbekistan will be held after 90 days of parliamentary elections.

Next parliamentary elections will be held in Uzbekistan in December 2014 and in line with the law, the presidential elections will be held in 2015.

Earlier, the presidential elections, in line with the legislation, are held after one year from parliamentary elections in Uzbekistan.

As reported earlier, in December 2011 Uzbekistan introduced changes to the Constitution to cut presidential term from seven years to five years.

It was emphasized that its adoption will contribute to and strengthen the guarantees of stability, the sustainability of the system of state power and control in the preparation and holding of elections, will give a powerful impetus to the further modernization of the state legal and political system, the deepening of democratic reforms, development of civil society in the country.

The senators discussed and approved also the laws, prepared within the framework of the concept for further deepening of democratic reforms and the formation of civil society in the country set out in the report of the President of Uzbekistan Islam Karimov at the joint session of Oliy Majlis of Uzbekistan on 12 November 2010.

These include the Law of the Republic of Uzbekistan “On introduction of changes and amendments to law of Uzbekistan “On guarantees of freedom of entrepreneurial activities”.

The document was developed in order to create maximum favorable conditions for further developing entrepreneurial activities, providing preferences and guarantees to business entities, including state support.

One of main novelties of the law is establishing of principle on priority of business entities rights. In line with the norms, any contradictions and vagueness of the legislation will be interpreted in favor of business entities.

Then the senators considered the law of the Republic of Uzbekistan “On family entrepreneurship” developed in accordance with the concept.

Noting the particular importance of this law in the Year of Family, senators underlined that family business is important part of small and private business and the law will create legal base for its development and strengthen legal guarantee for family entrepreneurship.

The document ensures legal conditions for developing family entrepreneurship in various sectors of economy and opening new jobs in the country.

Further, the senators considered the law of the Republic of Uzbekistan “On introduction of changes and amendments to the law “On insurance activity”.

The document was developed in order to execute the resolution of the President “On priority directions of further reforming and increasing sustainability of financial-banking system of Uzbekistan in 2011-2015 and achievement of high international rating figures” from 26 November 2010.

Senators underlined that the law is directed at further improving legislation on insurance activities, including regulation and carrying out activities of professional participants in insurance market, taking into account international insurance practices.

They approved the law “On introduction of changes to article 477 of the civil code of Uzbekistan” and law “On introduction of changes and amendments into some legislative acts of Uzbekistan in connection with adoption of the law “On exchange of credit information”.

These laws are directed at harmonizing some norms of legislative acts with the law of Uzbekistan “On exchange of credit information” which was adopted in 2011.

Changes and amendments to the law will increase responsibility of the insurance companies.

New amendments will also serve for reliable protection of rights and interests of insurers, clients and insurance beneficiaries. The law will help to develop insurance market.

Further, the senators considered and approved the law of the Republic of Uzbekistan “On introducing changes and amendments to Criminal Code and Code of the Republic of Uzbekistan on administrative responsibility”.

The document was directed at further improving legal and administrative legislation through strengthening for crimes and violation against morality, prevent actions, propaganda violation, cruelty and pornography.

After a thorough discussion, senators approved the law of the Republic of Uzbekistan “On joining of Uzbekistan to the Framework Convention of the World Health Organization’s on Tobacco Control (Geneva, 21 May 2003).”

The law “On introduction of changes and amendments to some legislative acts of Uzbekistan” was also reviewed and approved by them.

The document was developed to implement presidential resolution “On measures on implementation of clauses of the Hague Convention Abolishing the Requirement for Legalization for Foreign Public Documents (Hague, 5 October 1961)” from 5 July 2011.

Senators underlined that adoption of the law will significantly simplify order of certifying originality of foreign official documents.

Apostille will replace legalization procedure of official documents, created in one country and transferred to another.

In addition to that, senators decided to decline and direct to re-development the law “On introduction of changes and amendments the law of Uzbekistan “On foreign investments”.

They noted that the law required additional and more detailed development, taking into account priority tasks on improvement of investment activities, proposed by the President of Uzbekistan Islam Karimov at the session of the government dedicated to the 2011 results.

Further, senators considered the issue “On activities of the Senate of Oliy Majlis of the Republic of Uzbekistan in 2011.” Following the discussion, the Senate adopted the appropriate decision.

Then, the senators, in accordance with the constitutional powers heard the information and reports on the activities of several institutions, ministries and agencies in 2011.

On the recommendations of the Senate, use of funds allocated for construction, reconstruction, maintenance and equipping of professional colleges, land improvement, as well as the development of the service sector, the production of export and import goods, the creation of new jobs in the framework of the localization of production were audited during the period.

The senators expressed their proposals and recommendations aimed at strengthening and improving the effectiveness of control measures of the Accounting Chamber, taking the necessary measures to reduce financial crime and its prevention in the future.

The first day of the eighth plenary session of Senate of Oliy Majlis of Uzbekistan has been completed.
